Yesterday, the North Carolina Supreme Court heard oral arguments in Kirby v. N.C. Department of Transportation, a critical property rights case in which the Court must decide whether the state’s use of the Map Act constitutes a taking requiring just compensation under the North Carolina and United States Constitutions.
