The Senate Health Committee is debating a new version of H2, the statewide smoking ban, that now limits the ban to only bars and restaurants.
Private clubs and workplaces will be exempted from the ban.
Unfortunately, the bill still fails to provide an opt-out provision for those bars and restaurants to allow smoking if the so decided to do so. This fundamental protection is critical to protecting private property rights.
Since any bar, restaurant, private club or any other private business can opt-in and ban smoking at any point in time, a provision protecting an opt-out should be included.
